Case Overview

The patient fell at home and struck his head on a hard surface. He had a laceration on his scalp with no loss of consciousness, no headache, no nausea or vomiting. Instead, he was alert and oriented without any abnormal neurological signs or symptoms. He was seen by his doctor several times after the fall for an unrelated medical condition and had no neurological complaints during those visits. Approximately 10 days after the fall he complained of a severe headache and fell asleep and never woke up. An arterial bleed was discovered during surgery and was stopped. Unfortunately the patient suffered a brain herniation and passed away 10 days later. The jury found in favor of the defense.
